These Website Terms of Use ("Terms") govern your use of CloudSpectra.Ai (the "Site"). Your use of the Cloud Spectra software/appliance is governed separately by the End User License Agreement and, for paid subscriptions, the applicable order or AWS Marketplace terms.
1. Acceptance
By accessing the Site you agree to these Terms. If you do not agree, do not use the Site.
2. Permitted use
The Site is provided for informational purposes about Cloud Spectra products. You agree to use it lawfully and not to disrupt, scrape abusively, probe, or attempt to gain unauthorized access to it. Acceptable use of the product is covered by our Acceptable Use Policy.
3. Intellectual property
The Site and its content, trademarks, and logos are owned by Cloud Spectra LLC or its licensors. Except for the open-source components we identify, no license to our marks or content is granted by these Terms.
4. Third-party links & services
The Site links to and embeds third-party services (e.g. AWS Marketplace, Calendly, Cloudflare). We are not responsible for third-party sites or services and their terms govern your use of them.
5. Relays you operate
CloudSpectra VPN Twin creates a relay in your own cloud account, using credentials you supply. We do not host it, we do not own the address it carries, and we have no access to that account. You are its operator, and the following follow from that.
Your provider's charges are yours, and cancelling with us does not stop them. The relay is a machine on your provider's bill. It keeps running, and keeps costing you money, until you destroy it in your own provider account. Cancelling or letting a CloudSpectra subscription lapse ends our fee only. We cannot destroy, suspend, or recover the machine for you, and we are not responsible for provider charges you continue to incur after cancelling, including any usage or bandwidth overage on your provider's terms.
Securing access to the relay is yours. That includes the dashboard password, the SSH keys you install, and restricting which addresses may reach the management ports. By default the dashboard is reachable from the internet and protected only by that password; restricting it is available to you and is worth doing. The dashboard presents a self-signed certificate, because a relay identified by an IP address cannot hold a publicly trusted one -- verify its fingerprint against the one the relay records rather than accepting whatever a browser is shown.
What leaves the relay is attributed to you. Traffic carrying the relay's address is your responsibility, and use of the product is governed by our Acceptable Use Policy. Availability of the relay depends on your provider and on the machine you run, not on us; we do not offer an uptime commitment for infrastructure in your account.
The relay contacts a CloudSpectra control plane so that entitlement can be checked and an address can be moved between your devices. A subscription that has been cancelled, refunded, or suspended stops being served. Counsel to review scope, and to confirm this section sits correctly alongside the EULA, which covers the Software itself.
6. Disclaimers
The Site and all information on it are provided "as is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by law. Product capabilities, pricing, and savings figures on the Site are illustrative and may change; nothing on the Site is a binding offer or a guarantee of results.
7. Limitation of liability
To the maximum extent permitted by law, Cloud Spectra LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site. Counsel to set the aggregate liability cap and any carve-outs.
8. Governing law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws rules, and the state and federal courts located in Santa Clara County, California will have exclusive jurisdiction. Counsel to confirm venue/arbitration.
